These TERMS AND CONDITIONS FOR TEST DRIVE ("Terms") apply between individuals participating in a test drive (the "User"/"you") of a Zeekr vehicle ("Zeekr Vehicle") and Zeekr Netherlands B.V., with company reg no. 864677923 ("Zeekr").
By booking a Test Drive, the User confirms that they have read and agree to be bound by these Terms.
1.1 These Terms apply for the test drive of a Zeekr Vehicle which is provided by Zeekr free of charge to the User (the "Test Drive"), and subject to the provisions set forth in these Terms. The User acknowledges and agrees to only perform the Test Drive within the test area and time frame specified by Zeekr.
1.2 The Test Drive is intended for testing and evaluation purposes only and the User shall not use the Zeekr Vehicle for any other purpose, nor subject the Zeekr Vehicle to any unreasonable or unlawful use.
1.3 Please note that the Zeekr Vehicles used for the Test Drive are subject to availability. Zeekr will make reasonable efforts to ensure that you will be able to test drive the selected Zeekr Vehicle, but limitations in vehicle availability as well as unexpected events such as loss, failure or defects of the Zeekr Vehicle etc., may affect your ability to book a Test Drive. Further, Zeekr does not guarantee that the Zeekr Vehicle that you will Test Drive contains special functions or add-ons.
1.4 The Zeekr Vehicle will be available in the location agreed or specified in the booking for the Test Drive.
2.1 User is only permitted to participate in the Test Drive if User fulfils the requirements below. User guarantees to:
a. have a valid driver's license which gives the User permission to drive in the country where the Test Drive will take place;
b. not have committed any driving offences in the last three (3) years;
c. be in a good, healthy, and fit state to operate and drive the Zeekr Vehicle during the Test Drive;
d. not be suffering from any illness or disability (visible or not) which may make it unsafe to operate and drive the Zeekr Vehicle during the Test Drive; and
e. be at least 23 years of age.
2.2 User must carry their driver's license during the entire period of the Test Drive.
2.3 By accepting these Terms, the User guarantees not to operate the Zeekr Vehicle under the influence of any substance classified as an illegal drug under applicable law (as defined in section 7.1) under the influence of alcohol, or under the influence of any medicine that may affect the User's ability to operate the vehicle.
2.4 Zeekr personnel are permitted to safely stop and end the Test Drive at any given time, at their own discretion, if Zeekr personnel determine that the User no longer fulfills the requirements as described in this section 2, or if continuation of the Test Drive is deemed to be unsafe or may cause harm to the User or Zeekr or the Zeekr Vehicle, or if the User violates these Terms in any other way.
3.1 User is responsible for the allocated Zeekr Vehicle as well as any passenger during the entire period of the Test Drive. The User may not remove any parts or accessories from the Zeekr Vehicle or make any other modifications to the Zeekr Vehicle.
3.2 The User is not permitted to hand over the Zeekr Vehicle to a third party (including but not limited to passengers) during the Test Drive. If the User allows a third party to drive the Zeekr Vehicle during the Test Drive, the User will be solely liable for the Zeekr Vehicle in accordance with these Terms.
3.3 Pets or smoking are not permitted in the Zeekr Vehicle during the Test Drive.
3.4 User shall operate and treat the Zeekr Vehicle with care. User shall drive the Zeekr Vehicle in a safe and responsible manner in accordance with all applicable road traffic laws and regulations. The User must not drive the Zeekr Vehicle off-road, on unplowed roads or in any place where there is a risk of damage to the vehicle.
3.5 User shall keep the Zeekr Vehicle secure and locked when not using it and park the Zeekr Vehicle in a permitted location.
3.6 User shall return the Zeekr Vehicle in the same condition as when the Test Drive commenced (save for normal wear and tear that normally occurs during a Test Drive, according to Zeekr).
3.7 If the Zeekr Vehicle is not returned, Zeekr reserves the right to take all available actions to repossess the Zeekr Vehicle at User's expense. The User will indemnify Zeekr for all claims that may arise from such action and reimburse Zeekr for all related costs arising from such claims. Further, if the Zeekr Vehicle is returned damaged, Zeekr reserves the right to repair (or replace where applicable due to applicable laws and regulations) the Zeekr Vehicle to its original condition and charge User for the costs accordingly.
3.8 User shall return the Zeekr Vehicle to the location of where the Test Drive commenced, or according to Zeekr instructions as provided.
3.9 User is responsible for the settlement of any fines or penalties arising from the use of the Zeekr Vehicle during the Test Drive caused by User's negligence, such as, but not limited to, tolls, parking and/or speeding fines.
4.1 Zeekr is not liable for any direct or indirect losses and damages which may occur in connection with or during the execution of a Test Drive. By accepting these Terms and participating in the Test Drive of the Zeekr Vehicle, User hereby waives, for an indefinite period of time, the right to claim or take legal action against Zeekr relating to any loss, injury, costs, damage to property or person(s) including passengers and the User themselves, arising from or related to the Test Drive to the fullest extent permitted by law.
4.2 User shall indemnify and hold Zeekr harmless for any and all costs, claims, loss or any damage arising out of the Test Drive or the User's breach of its obligations under these Terms, including but not limited to loss or damage to third-party property and all liability for illness, injury or death of a third-party as well as any costs, claims and damages that may occur as a consequence thereof.
For online bookings: You have the right to cancel your booking of a Test Drive at any time until the Test Drive has started. To cancel your booking, please contact us using the contact details listed at the bottom of these Terms. You will not be charged anything if you do not cancel your booking or if you do not show up for your booked Test Drive, but we appreciate it if you let us know if you cannot attend so that another person has the opportunity to test drive the Zeekr Vehicle.
6.1 The Zeekr Vehicle contains a GPS tracking unit which will be active when the User drives the Zeekr Vehicle. This information is collected for safety and location purposes during the Test Drive only. By participating in the Test Drive, the User acknowledges that this GPS tracking will take place.
6.2 Without limiting the User's obligations in sections 2.1 and 2.2 above, Zeekr personnel will check and store a copy of the User's driver's license before commencing the Test Drive for six months for administrative and compliance purposes. 6.3 Any personal data collected and stored by Zeekr will be conducted according to applicable data privacy laws, including the General Data Protection Regulation (EU) 2016/679.

7.1 These Terms are governed by, and shall be interpreted according to, the laws and regulations of the Netherlands.
7.2 If you are a consumer, you have the right to raise disputes to The National Board for Consumer Disputes (NL: SGC Stichting Geschillencommissie voor Consumentenzaken).
